Terms of Service

1. The service

TenderBuilder (Dublin, Ireland) provides software that helps you read, interpret, and respond to Irish public-sector tenders. By creating an account or using the service, you agree to these terms.

2. Your account

You are responsible for keeping your login credentials secure and for any activity under your account. You must be at least 18 and authorised to bind the organisation you are tendering on behalf of.

3. Your content

You retain ownership of everything you upload (company profile, tender documents, drafts). You grant us a limited licence to host, process, and transmit that content to the model provider (Anthropic) solely to deliver the service. We do not use your content to train any model and we do not share it with third parties beyond the sub-processors listed in our Privacy Policy.

4. AI-generated drafts — your responsibility

TenderBuilder produces draft tender responses based on the documents and company profile you supply. You are responsible for reviewing every draft before submission. The service is a writing assistant; it is not legal, financial, or procurement advice. Drafts may contain placeholders, factual gaps, or inaccuracies that you must correct. Submitting a tender response is your decision and your liability.

6. Fees and billing

Paid subscriptions are billed monthly via Stripe in EUR, in advance, beginning on the day you subscribe. Prices exclude VAT where applicable. You can cancel at any time via the customer portal; cancellations take effect at the end of the current billing period and we do not pro-rate refunds. Failed payments may result in your subscription being suspended until payment is restored.

7. Service availability

We aim to keep the service available but make no specific uptime guarantee. We may perform scheduled maintenance and may temporarily restrict access if needed for security or capacity reasons. We will give reasonable notice for planned downtime where practicable.

8. Termination

You can delete your account at any time by emailing lewis@tenderbuilder.ie. We may suspend or terminate accounts that breach these terms, with notice where reasonable. On termination, your data is removed in line with the Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by law, the service is provided "as is". We are not liable for indirect, incidental, or consequential damages, including lost tenders, lost profits, or reputational harm arising from your use of the service. Our total aggregate liability in any 12-month period is capped at the fees you paid us in that period.

10. Governing law

These terms are governed by the laws of Ireland. Disputes are subject to the exclusive jurisdiction of the Irish courts.

11. Changes

We may update these terms from time to time. Material changes will be notified by email at least 14 days before they take effect; continued use after that date constitutes acceptance.
